May ipapadalang courtesy notice sa address ng iyong citation. Naglalaman ang abiso ng pangkalahatang impormasyon tungkol sa mga kinakailangan at opsyong available para malutas ang ticket, na posibleng kabilangan ng:

• Halaga ng piyansa, batay sa mga paglabag at kasaysayan ng pagmamaneho mo
• Patunay ng mga kinakailangan sa pagwawasto para sa mga mechanical na paglabag
• Mga kinakailangan sa mandatoryong appearance sa hukuman
• Mga kinakailangan sa pagiging kwalipikado ng traffic school
• May ibibigay na return envelope sa hukuman kasama ng courtesy notice.

Hindi court date ang petsa sa ibaba ng iyong citation. Dapat mong aksyunan ang iyong citation bago lumipas ang petsang ito.

Kung hindi ka pa nakakatanggap ng courtesy notice sa loob ng apat (4) na linggo pagkatapos mong matanggap ang citation, dalhin ang iyong citation sa isa sa mga window ng Dibisyon para sa Trapiko sa courthouse. Hindi legal na dahilan ang hindi pagtanggap ng courtesy notice para hindi maaksyunan ang citation. Responsibilidad mong lutasin ang citation sa o bago lumipas ang takdang petsa. Sa pagsusumite ng mga bayad at/o dokumento sa pamamagitan ng koreo, maglaan ng 10 araw para sa paghahatid at pagpoproseso. 

Kung hindi ka makakatanggap ng courtesy notice, posibleng:

• hindi natanggap ng Hukuman ang orihinal na citation mula sa ahensya sa pagpapatupad ng batas.
• Posibleng hindi updated ang kasalukuyan mong address sa Departamento ng Mga Sasakyang de Motor, at posibleng hindi mo naipakita sa opisyal na nagpalit ka ng address kasama ng iyong lisensya sa pagmamaneho.
• Posibleng mali o hindi kumpleto ang address na nakasulat sa citation.
• Posibleng may kulang na impormasyon sa citation at ibinalik ito sa opisyal para baguhin o iwasto.
• Error sa post office.

Responsibilidad mo pa ring makipag-ugnayan sa Hukuman, may matanggap ka mang abiso o wala. Kung hindi ka sigurado sa iyong mga opsyon, mag-appear sa Hukuman bago lumipas ang petsang nakalista sa ibaba ng iyong citation. 

Kung may problema ka sa pananalapi na nakakahadlang sa pagbabayad mo ng mga pangunahing pangangailangan sa sambahayan at sa buong halaga ng iyong traffic ticket, puwede mong hilingin sa Hukuman na isaalang-alang ang kakayahan mong magbayad.  Kung kwalipikado ka, puwedeng bawasan ng Hukuman ang halagang dapat mong bayaran.

Pagiging Kwalipikado

May tatlong paraan para maging kwalipikado sa pinamurang halaga alinsunod sa kakayahang magbayad:

1. Kung nakakatanggap ka ng mga pampublikong benepisyo sa ilalim ng: SSI, SSP, CalWORKS, Tribal TANF, GR, GA, CAPI, IHSS, o Medi-Cal,

2. Kung mas mababa sa halagang nakalista sa ibaba ang gross na buwanang kita ng iyong sambahayan (bago ang mga pagkakaltas para sa mga buwis):

3. Kung wala pang $400.00 ang iyong buwanang disposable na kita.

Responsibilidad mong magbigay ng dokumentasyon na sumusuporta sa isa sa tatlong kinakailangan para maging kwalipikado ka sa pinamurang halaga.

Paano humiling ng pagpapasya sa kakayahang magbayad

1. Sagutan ang Kahilingan para sa Pagpapasya sa Kakayahang Magbayad,

at

2. Sagutan ang Checklist sa Kakayahang Magbayad,

at

3. Isumite sa Tanggapan ng Clerk ang Kahilingan, Checklist, at dokumentasyong nakasaad sa Checklist.

Mahahalagang Tala

• Puwedeng humiling ang isang defendant ng pagpapasya sa kakayahang magbayad sa pag-adjudicate, o habang hindi pa nababayaran ang hatol, pati kapag hindi pa nababayaran ang isang kaso o na-refer ito sa pagsingil (Kodigo sa Sasakyan 42003(c)). 
• Ang pagpapasya sa kakayahang magbayad ay para lang sa mga infraction (hindi para sa mga misdemeanor o felony).
• Kapag napagpasyahan na ng hukuman ang kakayahan mong magbayad, puwede mong hilingin ditong isaalang-alang itong ulit kung may magbabago sa iyong sitwasyon sa pananalapi.

Mayroon kang karapatang ipetisyon ang Hukumang i-vacate ang sibil na assessment para sa mabuting hangarin (good cause). Ang mga halimbawa ng mabuting hangarin ay kinabibilangan ng, pero hindi limitado sa: 

• Duty sa militar sa labas ng estado
• Pagpapaospital
• Pagkakakulong
• Hindi ikaw ang taong naka-cite

Paano Magsumite ng Aplikasyon para Mag-vacate ng Sibil na Assessment

1. I-download ang form mula sa homepage ng Hukuman para sa Trapiko,
2. Sagutan ang form,
3. Isumite ang form sa pamamagitan ng koreo o nang personal sa Dibisyon para sa Trapiko  Fremont, Oakland (Wiley W. Manuel), or Dublin (East County Hall of Justice) 
4. Bagama't hindi mo kailangang magsumite ng patunay ng ‘mabuting hangarin’ kasama ng iyong aplikasyon, lubos itong inirerekomenda. 

May opisyal ng hukuman na susuri sa iyong aplikasyon at mga kalakip, at magpapadala ng abiso sa pasya sa address na nakasaad sa iyong aplikasyon.

Nalalapat lang ang mga sumusunod kung mayroon kang paunang itinakdang arraignment o paunang itinakdang petsa ng paglilitis sa hukuman.

Puwede mong tingnan ang iyong (mga) paunang itinakdang court date gamit ang Online na Serbisyong Hanapin ang Iyong Court Date.

Puwede mo ring makuha ang impormasyong ito sa counter sa trapiko ng courthouse sa pamamagitan ng telepono. Pakihanda ang numero ng iyong docket o citation.

Nakatanggap ako ng citation na para sa ibang tao. Paano ko ito maki-clear?

Hindi Photo Redlight Citation

Kung sa palagay ay mo hindi mo dapat natanggap ang isang citation o abiso mula sa hukuman dahil may ibang taong gumamit ng iyong pangalan o iba pang pagkakakilanlan, dapat kang mag-sign up para sa Walk-In na Hukuman at dapat mong dalhin ang iyong patunay ng pagkakakilanlan.

Photo Redlight Citation

Pagkatapos makakuha ng larawan sa red light camera, makakatanggap ang rehistradong may-ari ng sasakyan ng citation sa koreo. Mayroon din itong mga tagubilin sa susunod na dapat gawin, pati sa dapat mong gawin kung hindi ikaw, ang rehistradong may-ari, ang nakunan ng larawan sa likod ng manibela.

Hindi ang nagmamaneho?  Huwag bayaran ang citation kung may plano kang hilinging ipaalis ito sa pangalan mo.

Kung ikaw ang may-ari at iba ang nagmamaneho, gawin ang mga sumusunod:

• Sagutan ang seksyong "OPSYON A: AFFIDAVIT NG KAWALAN NG PANANAGUTAN-KUNG HINDI IKAW ANG NAGMAMANEHO (OPTION A: AFFIDAVIT OF NON-LIABILITY-IF YOU WERE NOT THE DRIVER)" sa dokumentong 'Affidavit ng Kawalan ng Pananagutan na May Piyansa (Affidavit of Non Liability With BAIL).'
• Gamitin ang na-print nang return address para maibalik ng Photo Redlight Vendor ang dokumento para sa pagpoproseso.

Ang mga citation ng Juvenile, misdemeanor na paglabag sa trapiko ng Juvenile, 14601.1s, 12500s, at VC 20002 ay pinoproseso sa pamamagitan ng Departamento sa Probation kasama ng iba pang paglabag ng Juvenile.

Ang mga citation ng infraction sa trapiko na iniisyu sa mga menor de edad ay pinoproseso at ina-adjudicate sa Dibisyon para sa Trapiko ng Superior Court. May ipapadalang courtesy notice sa Magulang/Tagapangalaga ng juvenile sa address na nakalista sa citation sa loob ng apat na linggo pagkalipas ng petsa ng pag-isyu sa citation. Sundin ang mga tagubilin sa abiso.

Hindi court date ang petsa sa ibaba ng citation. Makakatanggap ka ng courtesy notice bago lumipas ang petsang ito. Kung hindi ka pa nakakatanggap ng notice sa loob ng apat na linggo pagkatapos mong matanggap ang citation, dalhin ang iyong citation kasama ng iyong Magulang/Tagapangalaga sa isa sa mga window ng Dibisyon para sa Trapiko sa Courthouse.

Posibleng kwalipikado ang juvenile na pumasok sa traffic school kung hindi siya pumasok sa ganito sa nakalipas na 18 buwan.  Kinakalkula ang 18 buwan mula sa petsa ng paglabag, hindi sa kung kailan huling pumasok sa traffic school.  Dapat magbayad ng pang-administratibong bayad sa Hukuman, at ng bayad sa Traffic School. Kapag matagumpay nang nakumpleto ang Traffic School, idi-dismiss na ang citation.

Kung gustong i-contest ng juvenile ang citation, dapat mag-iskedyul ang Magulang/Tagapangalaga ng pagdinig kung saan may appearance dapat ang Magulang/Tagapangalaga kasama ang juvenile. Puwede itong gawin ng Magulang/Tagapangalaga nang personal o sa pamamagitan ng koreo.

Kung walang appearance o kung hindi masusunod ang mga tagubilin sa Courtesy Notice, iho-hold ang talaan sa pagmamaneho ng juvenile, tataasan ang piyansa, at posibleng maapektuhan ang insurance ng Magulang/Tagapangalaga.

Detalyadong Breakdown

May ina-assess na base na multa sa bawat paglabag na nakalista sa isang citation. Bukod sa base na multa, mayroon pang mga karagdagang assessment, na bumubuo sa kabuuang halaga ng multang dapat bayaran sa hukuman. Ang kabuuang multang dapat bayaran ay puwede ring madagdagan batay sa mga dating talaan o puntos sa talaan sa pagmamaneho ng isang indibidwal. Ang mga halagang ipinapakita sa ibaba ay nalalapat sa County ng Alameda, at posibleng hindi mailapat sa iba pang county. Puwedeng kalkulahin gaya ng sumusunod ang kabuuang multa para sa mga paglabag sa trapiko:

Base na Multang itinakda ng batas at Konseho ng Hukuman ng California. Assessment sa Parusa: Inilalaan ang mga assessment sa parusa para sa mga nasabing item bilang konstruksyon ng pasilidad ng hukuman at kulungan at iba pang item, gaya ng nakasaad sa ibaba.

• Napupunta ang $10.00 bawat $10/base na multa bawat PC 1464 70% sa Trust Fund ng Hukuman para sa Paglilitis ng Estado; 30% sa Pangkalahatang Pondo ng County.
• Napupunta ang $2.00 bawat $10/base na multa bawat GC 76100 sa pondo sa konstruksyon ng Courthouse ng County.

Iskedyul ng Piyansa

Bukod pa rito, puwede pang madagdagan ang mga multa alinsunod sa Kodigo sa Sasakyan 42009 para sa paggawa ng offense habang nagmamaneho sa isang konstruksyon o lugar ng pagmementina ng highway at alinsunod sa Kodigo sa Sasakyan 40210 para sa mga paglabag na ginawa sa isang Pagpapahusay sa Kaligtasan-Zone na May Dobleng Multa. May mga espesyal na paglabag na may mas malalaking multa para sa mga paglabag sa isang zone ng paaralan, distrito ng negosyo, zone para sa mga nakatatanda, o railroad crossing.

Naglilista ang talahanayan sa ibaba ng mga halimbawa ng kabuuang piyansang dapat bayaran para sa isang multa sa trapiko. Hindi kasama sa mga halagang ito ang anumang karagdagang assessment na dapat bayaran dahil sa mga dating talaan o puntos sa talaan sa pagmamaneho. Kung papayagan ang Traffic School, magdaragdag ng $59.00 sa kabuuang multang dapat bayaran. 

Ano ang Assessment sa Parusa?

Ang Assessment sa Penalty ay isang halagang idinaragdag sa lahat ng multa at piyansa para sa mga infraction at low grade na misdemeanor na offense. Sinisingil ito alinsunod sa Seksyon 76000 ng Kodigo ng Pamahalaan at Seksyon 1464 ng Kodigo Penal ng Estado ng California, at puwede itong baguhin ng Lehislatura. 1. Paano ko mababawi ang aking piyansa?

Ipapadala namin, sa pamamagitan ng koreo, ang refund ng piyansa sa depositor (taong nagdeposito ng pera sa Hukuman), maliban na lang kung may mga espesyal kang isinaayos para kunin ang tseke ng refund. Dapat magpakita ang depositor ng ID para makuha niya ang tseke.

2. Gaano katagal ito aabutin?

Ipapadala namin, sa pamamagitan ng koreo, ang mga refund ng piyansa sa loob ng 30 araw ng negosyo pagkatapos ng disposition ng kaso, o 30 araw ng negosyo pagkatapos ang kautusan sa exoneration.

3. Kanino ipapadala ng hukuman ang refund ng piyansa?

Ipapadala namin ang tseke ng refund sa taong nagdeposito sa piyansa (ang depositor). Ang depositor ay ang taong lumagda sa personal na tseke, money order, o cashier’s check.

4. Kung nagbago ang address ko, paano ko ito maipapaalam sa hukuman?

Kapag nagpunta ka sa hukuman, sabihin sa Deputy, Komisyoner, o Clerk na nagbago ang address mo. O kaya, puwede kang magpadala ng liham sa hukuman na nagpapabatid sa kanila ng pagbabago ng address mo. 

Kung gusto mong iapela ang pasya sa pang-administratibong pagdinig na ginawa sa iyong paglabag sa parking ng entity sa ticketing (lungsod, county, at iba pa), mayroon kang 30 araw mula sa petsa ng pagpapadala sa pasya na maghain ng Apela sa Superior Court.  Sundin ang mga tagubiling ibibigay sa iyo ng entity sa ticketing. 

Kung pipiliin mong iapela ang kanilang pasya, dapat mong ihain ang iyong Apela sa sibil na dibisyon ng Superior Court na nasa Rene C. Davidson Courthouse, 1225 Fallon Street, Oakland, o Hayward Hall of Justice, 24405 Amador Street, Hayward.  May $25 na bayad sa paghahain ng iyong Apela.

You can pay your citation over the telephone using our Automated Phone System (IVR) 1-866-822-0560. You will need a touch-tone telephone and a credit card (VISA and MasterCard accepted). Please follow the instructions on your courtesy notice for the appropriate phone number to call. There is a $6.00 convenience fee to use this service. Please note: Some citations cannot be processed using the Automated Phone System.

To pay by mail

Write your case number on your check and all correspondence. Make checks/money orders payable to "Alameda Superior Court". Mail the return portion of the courtesy notice and payment to the Court address listed on the Reminder notice. VISA and MasterCard accepted.

To pay in person

Visit the courthouse's Traffic Division to pay your Citation, at the Traffic counter. VISA and MasterCard accepted.

Fines

If you plead guilty or are found guilty by the Commissioner, you will be fined. You may pay the amount of the fine that same day or enter into a contract to make monthly payments until the fine is paid. If you are unable to pay the fine, you may request volunteer work at your court appearance. With this option, you work your fine off at the rate of $31.00 per hour.

Collection Agency

Fix It - Proof of Correction

Correct (fix) the violation and then contact any law enforcement agency to arrange for an officer to verify and sign off on the correction. You can mail or bring the the signed verification to the Courthouse's Traffic Division along with the state mandated fee (40611 CVC) no later than the due date shown on your courtesy notice, to clear the violation.

Registration - Proof of Correction

If you are charged with expired registration, mail a copy of your current registration or bring your current registration to Courthouse's Traffic Division by the due date shown on your courtesy notice along with the state mandated fee (40611 CVC).

Driver's License - Proof of Correction

For driver's license violations, mail a copy of your driver's license or a citation/courtesy notice which has been signed off by the DMV or bring these or your driver's license to the Courthouse's Traffic Division by the due date shown on your courtesy notice along with the state mandated fee (40611 CVC).

Insurance - Proof of Correction

If you are charged with no proof of insurance, mail or bring proof that you were insured on the date of the violation to the Courthouse's Traffic Division counter by the due date shown on your courtesy notice along with the state mandated fee (40611 CVC).

Valid proof of insurance may be any one of the following:

• A photocopy of the official card issued by an insurance company showing name of the insurance company, including:
  • policy number
  • effective (beginning and ending) dates of the policy (policy must be in effect at the time of the violation)
  • name of defendant or vehicle information (must match person or vehicle listed on the citation)
• A photocopy of the actual insurance policy providing all of the above information
• A statement on insurance company letterhead providing all of the above information

Notice to Correct (CHP 281)

This citation is issued by the California Highway Patrol for certain types of correctable violations. You are required to submit proof of correction(s) directly to the CHP within 30 days from date of violation. Failure to comply will result in the citation being referred to the court.

Why is there a proof of correction fee when the officer said there would be no fee?

The proof of correction fee is statutory (Vehicle Code section 40611) for all correctable violations.

Am I responsible for an equipment violation on a car I am driving that is not mine?

Yes, unless the ticket is issued in the name of the registered owner of the vehicle you are driving.

What if I have sold the car that was cited for an equipment violation or it is inoperable?

Selling a vehicle that has been cited for mechanical violations does not relieve the owner of the responsibility of the proof of correction for those violations. If you have sold or donated the car or it has become inoperable, you must set a court date to appear and provide proof of sale, donation, or inoperability to clear the ticket. You should support your case with any relevant paperwork.

DMV Hold

A DMV hold may be set for failure to appear (40508a CVC), or a failure to comply (40508c CVC). To clear a DMV Hold, you must post and forfeit bail or post bail and schedule a future court date. The DMV hold is removed once bail is posted.

Note: if you want a trial, payment can only be made at the court, or via US Post, not online.

Make Money Order or Cashier's Check payable to CLERK OF THE COURT. Write your case number on the check and any correspondence. Mail the return portion of the courtesy notice and payment to the Court address listed on the courtesy notice. You will receive your court date, if needed, by return mail.

The Citation Date the officer writes next to WHEN on the citation indicates that by or before that date you should receive a Courtesy Notice.

If you have not received a Courtesy Notice by or before the Citation Date, contact us at Ask Traffic.

Failure to appear or to resolve a citation on or before the due date may result in a DMV hold being placed on your driver's license. Your bail may also be increased and a Civil Assessment imposed. A DMV hold will restrict your driving privileges and/or ability to register a vehicle. The citation may also be referred to a collection agency for the collection of payments due. In addition, the court may deem your failure to appear as an election to proceed with the case by trial by written declaration pursuant to Vehicle Code section 40903.

Attention: Failure to pay your fine may result in increased financial penalties.

Failure to Appear (40508a CVC)

Failure to appear on your scheduled court date may result in one or more of the following penalties:

• A Civil Assessment may be imposed and your case referred to collection
• You may be tried in absentia (in your absence)

Civil Assessment

Pursuant to Penal Code 1214.1, ". . . the court may impose a civil assessment of $100 against any defendant who fails, after notice and without good cause, to appear in court for any proceeding authorized by law or who fails to pay all or any portion of a fine ordered by the court."

Acceptable good cause is defined as written proof of medical incapacitation, hospitalization, incarceration, or out-of-state military duty. Proof must be verifiable and written on appropriate letterhead stationery.

Failure to respond within 15 days of a Civil Assessment notice will result in the entry of a civil judgment and referred to collection. In addition, a request may be sent to DMV to suspend your driver's license based on your failure to appear.

To avoid these penalties, the original bail plus the civil assessment amount must be received by the court within 15 days of the notice. Proof of correction for appropriate violations must accompany the payment to clear the case. Return the notice with your payment and any required proof of correction. 

Owner's Responsibility

When a "hold" is issued, a notice is usually mailed to you. This notice informs you that additional fees were added to the original bail amount owed. Once the Court issues a "hold" on your citation, you may not be able to register your vehicle until this issue is resolved. Once the bail/fine is paid or a court appointment is reserved, the court will remove the DMV hold.

DMV Hold

When a "hold" is issued, a notice is usually mailed to you. This notice informs you that additional fees were added to the original bail amount owed. Once the Court issues a "hold" on your citation, you may not be able to renew your license until this issue is resolved.

Once the bail/fine is paid or a court appointment is reserved, the court will remove the DMV hold.

The due date shown on your courtesy notice may be extended only once. This one time extension of 30 days may be requested:

•  Online
• At the Courthouse traffic counter (See your citation for appropriate location).
• By US mail (See your citation for appropriate location).
• By telephone (See your citation for appropriate location). Please have your case number or citation number ready.

Extensions for more than 30 days require a court appearance. Extensions may not be granted on delinquent matters.

What is a Photo Red Light Violation

Cameras have been installed at specific signal controlled intersections to take video and pictures of vehicles which cross the intersection on a red light. A photo is taken of the front of the vehicle and front license plate when the vehicle’s speed and position trip a sensor located before the intersection a photo is also taken of the driver when the vehicle enters the intersection on a red light. The photo information is submitted to law enforcement through an automated records database and a citation is mailed to the registered owner of the vehicle.

Courtesy Notice

You will receive two courtesy notices, one from the Redlight Vendor and one from the Court. They will outline the details of your violation and your options to resolve the violation.

Payment

Payment may be made online, using our IVR phone system 1-866-822-0560, by mail, or in person.

Not the Owner

If you are the person in the Red Light camera photograph and were driving a company car, do the following: Have your company complete the "OPTION A: AFFIDAVIT OF NON-LIABILITY-IF YOU WERE NOT THE DRIVER" section on the 'Affidavit on Non Liability With Bail' document. Use the pre-printed return address for the Photo Redlight Vendor to send the document back for processing.

DO NOT SEND this document to the court.  Doing so will result in delaying processing for your citation.

It is recommended that the requested documentation be sent certified mail with a return receipt.

Upon receipt of the above documentation, the Citing Agency will dismiss the citation from the company's name and issue a citation to the person that has been identified as the driver. The citation in the company's name will not be dismissed until the Court has received the completed identification form or payment has been made.

If the citation is to be taken out of the company name: DO NOT PAY THE CITATION.
