민사 직접 심리 일정 담당 부서에 할당된 모든 사건에는 배정 통지서가 발송됩니다. 직접 심리 일정 사건의 법안, 신청 및 일방적 신청은 해당 사건이 배정된 부서에서 심리합니다. 다른 모든 사건의 법안, 신청 및 일방적 신청(불법 점유 포함)은 511 부서에서 심리합니다.
신청
모든 사건에서 법원에 신청을 제기하는 당사자가 해야 할 일은 다음과 같습니다.
- 해당 부서에 심리 날짜 예약
- 법원에 신청서 제출
- 상대측에 관련 내용 송달
한쪽 당사자가 법률에 따라 심리 통지서를 제공해야 합니다. 대부분의 신청에는 캘리포니아주 민사소송법 1005, 1010조(이하 내용 포함)가 적용됩니다. 불법 점유 및 기타 민사 사건과 관련한 기타 요구 사항은 아래를 참조하십시오.
일방적 신청
모든 사건에서 법원에 일방적 신청을 제기하는 당사자가 해야 할 일은 다음과 같습니다.
- 해당 부서에 심리 날짜 예약(심리가 필요한 신청인 경우)
- 법원에 신청서 제출
- 법률에 따라 심리 날짜 통지서 제공

퇴거(불법 점유) 및 기타 민사 사건
퇴거(불법 점유)를 비롯해 직접 심리 일정 부서에 배정되지 않은 사건은 511 부서에서 관리합니다.
- 전자 법원 공개 포털
- 에 로그인하여 "법원 예약" 클릭
- "예약하기" 선택
- 일정 사용자 동의서를 읽고 "동의합니다" 선택
- 사건 번호를 입력하고 "제출" 선택
- 필수 필드 작성
- "계속" 선택
- 일정에서 날짜/시간 선택
- 계약 정보 입력
- 카드 정보 입력
- "예약 제출" 선택
예약 번호와 정보가 제공되며 확인 이메일이 발송됩니다.
511 부서 법안 및 신청 일정: 월요일, 화요일 오전 9시 30분, 수요일 오후 1시 30분
511 부서에 예약된 신청 심리는 507, 511, 512, 514 또는 519 부서에서 개최될 수 있으며 이들 부서는 모두 헤이워드 사법관(주소: 24405 Amador Street, Hayward)에 있습니다.

불법 점유 사건 관련 특별 참고 사항

통지 기간이 짧을 수 있습니다. 캘리포니아주 민사소송법 1167.5, 1170.7, 1170.8조 및 여타 규정에 따라 불법 점유 사건 중 일부 신청에는 통지 기간이 짧게 정해져 있습니다.

퇴거 유예 신청서는 민사 사건을 담당하는 법원이라면 어디에든 제출해도 됩니다.

이러한 신청은 법원에서 심리 없이 결정을 내립니다.
임시 판결
법원에서는 보통 대부분의 법안 및 신청 사안에 대해 이틀 전에 임시 판결을 내립니다. 법원의 임시 판결은 법원 명령이 됩니다. 단, 법원에서 양측 당사자의 출석을 지시했거나 한쪽 당사자가 직접 출석하여 신청에 대한 변론을 전개하겠다는 의도 통지서를 제출한 경우는 예외입니다. 임시 판결에 관한 자세한 정보는 여기 를 클릭하여 확인하시기 바랍니다.

Other Important Information
In every case, to present a motion to the court, a party must:
- reserve a hearing date with the applicable department,
- file the motion with the court, and
- serve the other parties.
A party must give notice of the hearing as required by law. California Code of Civil Procedure Sections 1005 and 1010 et seq. apply to most motions. See below for additional requirements for unlawful detainers and other civil cases.
In every case, to present an ex parte application to the court, a party must:
- reserve a hearing date with the applicable department (for applications that require a hearing.) Ex parte reservations shall be obtained from the courtroom. They cannot be obtained via the portal.
- file the motion with the court, and
- give notice of the hearing date as required by law.
California Rules of Court 3.1200 et seq. apply to ex parte applications. See below for additional requirements for unlawful detainers and other civil cases.
Civil Direct Calendar Departments

Evictions (Unlawful Detainers) and Other Civil Cases
Evictions (unlawful detainers) and cases that are not assigned to a direct calendar department are managed by Department 511.
- Log into eCourt Public Portal
- Select "Court Reservations"
- Select "Make a Reservation"
- Read Calendar User Agreement and select "I Agree"
- Enter your Case Number and select "Submit"
- Complete the Required Fields
- Select "Continue"
- Select a Date/Time from the Calendar
- Enter Contract Information
- Enter Card Information
- Select "Submit Reservation"
A reservation number and information will be provided, and a confirmation email is sent.
Dept. 511 Law & Motion Schedule: Monday and Tuesday at 9:30 a.m. and Wednesdays at 1:30 p.m.
Dept. 511 Ex Parte Schedule: Monday and Tuesday at 9:15 a.m. and Wednesday at 1:30 p.m.

Shorter Notice Periods May Apply. California Code of Civil Procedure Sections 1167.5, 1170.7, 1170.8, and other statutes set shorter notice periods for some motions in unlawful detainer cases.

Applications to Stay Evictions can be filed at any court location that accepts civil filings:
- René C. Davidson Courthouse (Oakland), and
- Hayward Hall of Justice (Hayward).
The court decides these applications without a hearing.
