Court Divisions - Probate & Guardianship The probate court hears matters concerning probated estates, including: The probate examiners are paralegals employed by the court to review all papers filed with the probate court. They check filings for compliance with the probate code, local court rules and the policies of the court. As a result of this review, the examiners may identify procedural deficiencies or other concerns that need to be further addressed before the court hears the matter. The written results of the examiners' review - the examiners' notes - are made available by the court on the court's website, usually the day before the hearing date. The notes for each matter on the calendar may be viewed by anyone with Internet access. (Those without Internet access may review the examiners' notes at the court.) If no problems were found, the case will be listed on the court's pre-grant list, also found at the same website. The attorneys meet with the probate examiners on the morning of the hearing for their matter to review or correct any procedural deficiencies that have been identified by the examiners.

Forms are available at the Probate window in the Courthouse at 1225 FallonStreet, Room 109 in Oakland. A "Handbook forConservators" is available for $20.00. Clerks are forbidden by law to givelegal advice. They cannot tell you which forms to use, how to fill out forms orwhat procedures you should follow. If you need assistance, consult with anattorney.

Case Research and Case Status

Search requests are not taken over the phone. Information regarding aspecific case cannot be given over the phone. You may come into the office at1225 Fallon Street, Room 109, in Oakland or you may put your request forinformation in writing. There is a $15.00 per name charge for search requestsreceived by mail.

Fee Waivers

If you feel that you cannot afford to pay court fees, you may apply for afee waiver. You will be asked to provide information regarding your financialstatus, which will be reviewed by a judge. Fee waiver form packets areavailable at no cost at the probate window in Room 109 of the Courthouse. TheLegal Aid Society of Alameda County also may be able to provide legalassistance.
