Important Notice for Dept. 31:

LAW AND MOTION:
All civil law and motion matters will be heard at 9:00 a.m. by the Honorable Winifred Y. Smith, or at 2:00 p.m. by the Honorable Frank Roesch. All cases ending in an odd number will be heard on the 9:00 a.m. calendar, while cases ending in an even number will be heard on the 2:00 p.m. calendar.

EX PARTE ORDERS:
All requests for ex parte relief, except those to be heard by the designated case management department as described in Local Superior Court Rule 4.4(2), will be heard in Department 31 at 1:30 p.m. by the Honorable Winifred Y. Smith, or at 8:45 a.m. by the Honorable Frank Roesch. All requests for ex parte relief shall be by appointment only. Appointments shall be made 24 hours or more before the ex parte appearance. A reservation of appointment may be made by calling the Department 31 clerk at (510) 268-5105, or the filing venue of the case as follows:

Hours of Operation

Monday through Friday (except holidays), 8:30 a.m. - 4:00 p.m.

Calendar Office, Room 207, is open from 8:30 a.m. to 12:00 noon, and from 1:00 p.m. to 4:00 p.m.

The courtroom is open to the public at 9:00 a.m.

The courtroom is closed for lunch from 12:00 noon to 1:30 p.m.

Calendar Office telephone is available from 8:30 a.m. to 12:00 a.m., and 1:00 p.m. to 4:00 p.m.

Law and Motion Calendar

The Dept. 31 calendar is called at 9:00 a.m. daily and at 2:00 p.m. daily. To calendar a law and motion matter, counsel may call the calendar office to schedule a hearing date, (510) 208-3949, or any of our other Civil Offices depending upon the filing venue of the case.

Ex Parte Applications

Filers must reserve a date for ex parte hearings, with proper notice to all parties pursuant to Cal. Rules of Court, rule 379. Ex parte applications are heard daily at 8:45 a.m. and 1:30 p.m. in Department 31. Matters are assigned to either the 8:45 a.m. or 1:30 p.m. calendar according to case number. Counsel shall bring all documents (application, supporting pleadings and proposed order) to the hearing.  Do not lodge these documents with the court in advance.

NOTE: Parties that have been assigned to a case management department should check with that department before scheduling a motion.
